성남이혼변호사 정부가 지난 12일 공개한 공소청·중대범죄수사청 법안에 항의해 범정부 검찰개혁추진단 자문위원회 일부 위원이 사의를 표했다. 중수청 수사 대상을 검찰보다 더 넓히고, 현재의 ‘검사·수사관’ ‘대검찰청·고등검찰청·지방검찰청’ 구조도 유지한 정부안이 “개혁에 반한다”는 것이다.
13일 취재를 종합하면 검찰개혁추진단 자문위원 16명 중 서보학 경희대 법학전문대학원 교수, 한동수·김필성·김성진 변호사, 황문규 중부대 경찰행정학 교수 등 총 6명이 이날 저녁 정례회의에서 동반 사의를 표했다. 이들은 입장을 내고 “국무총리실 검찰개혁추진단은 해체돼야 할 검찰권력을 오히려 ‘되살리는 방향으로’ 검찰개혁을 추진하고 있다는 강한 의구심을 던지지 않을 수 없다”며 “그 과정에 ‘자문위원회’를 배제하고 개혁을 바라는 국민들의 염원을 저버린 것으로 판단해 사퇴를 결정했다”고 밝혔다. 이어 “자문위 밖에서도 시대적 과제인 검찰개혁의 완수를 위해 최선을 다하겠다”고 했다. 일부 자문위원은 “자문위를 정부안 명분 쌓기용 ‘들러리’로 세운 것 아니냐”고 비판했다.
정부안에 담긴 중수청 수사 대상 범죄는 자문위에서 논의한 것보다 많은 9가지다. 이 중 사이버범죄 등은 자문위에서 아예 논의가 없었던 것으로 전해졌다. 정부안에는 경찰 등과 같은 사건을 수사하는 경우 중수청이 사건을 이첩하거나 이첩받을 수 있는 우선권을 갖는다는 내용도 들어갔다. 중수청 수사관을 ‘수사사법관·전문(일반)수사관’으로 이원화한 것이나 공소청을 ‘대공소청·고등공소청·지방공소청’으로 둔 것을 놓고 “현 검찰청 구조를 그대로 가지고 온 것이어서 개혁에 반한다”는 반대 의견도 나왔다. 중수청이 수사를 개시하면 공소청에 통보하도록 한 것은 공소청을 중수청의 수직적 상급기관으로 두려는 것이라는 비판도 제기됐다.
정부안이 공개된 이후 열린 첫 자문위 회의여서 다양한 의견이 나왔다. 사의를 밝히지 않은 위원들도 자문위의 위상과 역할에 대한 불만을 회의에서 제기했다.
공소청 검사들에게 보완수사권을 부여할지 여부는 향후 더 큰 쟁점이 될 것으로 전망된다. 추진단은 그간 ‘보완수사권 논의는 형사소송법 개정 사항’이라며 본격적인 논의는 하지 않은 것으로 알려졌다. 앞서 한 차례 진행된 보완수사권에 대한 자문위 논의에선 10 대 6 정도로 공소청에 보완수사권을 남겨야 한다는 의견이 우세했다고 한다. 서류만 보고 기소 여부를 판단하면 공소를 유지하기 어렵다는 주장과 검찰(공소청)에 어떤 수사권도 남겨선 안 된다는 의견으로 갈렸다. 문재인 정부 수사권 조정 때 사라진 전건 송치 부활 여부도 논의해야 한다. 전건 송치는 1차 수사기관이 수사한 모든 사건을 기소·불기소와 상관없이 공소청에 넘기는 것을 말한다. 검찰은 경찰이 수사권을 독점한 상황에서 견제 장치로 전건 송치 제도를 부활해야 한다는 입장이다.
