흥신소 생활고를 이유로 고등학생 두 아들과 아내가 탄 차를 바다로 돌진시켜 살해한 40대가 항소심에서 감형됐다.
광주고법 형사2부(이의영 고법판사)는 13일 살인·자살방조 혐의로 기소된 A씨(49)에 대한 항소심에서 무기징역을 선고한 원심을 깨고 징역 30년을 선고했다.
재판부는 “독립된 인격체이자 보호 대상인 자녀의 생명을 빼앗은 행위는 비난 가능성이 매우 크다”며 “범행 직후 119에 구조 요청했다면 참혹한 결과로 이어지지 않았을 것”이라고 지적했다.
그러면서도 “12년 이상 조울증 아내를 간병하는 등 긴 시간 가장의 책임을 짊어져 왔고, 반사회적 동기로 범행을 한 것은 아니다”며 “본인만 살아남아 평생 죄책감을 안고 살아갈 것으로 보이는 점 등을 감안했다”고 설명했다.
A씨는 지난해 6월1일 오전 1시12분쯤 전남 진도군 임회면 진도항에서 아내와 고등학생 두 아들을 태운 승용차를 몰고 바다로 돌진해 이들을 숨지게 한 혐의로 구속기소됐다.
그는 가족에게 수면제를 먹이고 범행을 저지른 것으로 드러났다. A씨는 사고 직후 열려있던 차창으로 탈출해 홀로 목숨을 건졌다. 그러나 그는 구조 요청을 하지 않고 광주로 도주했다가 경찰에 붙잡혔다.
A씨는 카드 빚 등 2억원의 채무와 자신이 관리한 일용직 노동자들의 임금 3000만원을 체불한 것으로 조사되기도 했다.
‘쌍방울 대북송금 사건’에서 제기된 ‘진술 회유 의혹’을 수사하는 검찰이 김성태 전 쌍방울 회장 2차 소환일을 오는 20일로 재조정 했다.
14일 경향신문 취재를 종합하면 서울고검 인권침해점검 태스크포스(TF)는 김 전 회장에게 오는 20일 오전 10시에 2차 조사를 받으라고 재통보했다. 애초 서울고검은 이날 오전 10시에 김 전 회장을 소환할 계획이었는데 전날 날짜를 조정한 것으로 알려졌다. 김 전 회장은 업무상 횡령 및 배임, 위계에 의한 공무 집행 방해 등 혐의를 받는다.
김 전 회장은 쌍방울 대북송금 사건 재판에서 이재명 대통령에게 불리하게 증언을 번복하도록 안부수 아태평화교류협회장과 그의 딸에게 회삿돈으로 금전적 혜택을 제공하도록 하고, 2023년 5월17일 이화영 전 경기도 평화부지사 등의 조사가 진행된 수원지검 조사실에 연어와 술 등 외부음식을 반입하도록 지시한 혐의를 받는다. 서울고검 TF는 쌍방울 측이 안 회장 측에 제공한 금액이 약 1억원이라 보고 있다. 또 쌍방울 법인카드 내역 중 술을 구매한 사실을 확인했으며, 이 술이 수원지검에 반입됐을 가능성에 무게를 두고 수사하고 있다. 검찰은 1차 조사에서 이와 관련한 내용 등을 추궁한 것으로 알려졌다.
김 전 회장은 자신의 혐의와 관련해 “(안 회장과) 대북사업을 같이했고 앞으로도 필요한 관계에서 모른 척 할 수 없었다”며 “당시 안 회장이 구속된 상태에서 부친을 보살펴야 하는 딸에 대한 도의적인 차원에서 제공한 것이지 ‘진술 회유’ 매수의 목적이 아니었다” 취지로 주장한 것으로 알려졌다. 또 술 등의 구매 경위를 알지 못하고 “조사실에 반입된 사실이 없다”고도 밝혔다.

광주고법 형사2부(이의영 고법판사)는 13일 살인·자살방조 혐의로 기소된 A씨(49)에 대한 항소심에서 무기징역을 선고한 원심을 깨고 징역 30년을 선고했다.
재판부는 “독립된 인격체이자 보호 대상인 자녀의 생명을 빼앗은 행위는 비난 가능성이 매우 크다”며 “범행 직후 119에 구조 요청했다면 참혹한 결과로 이어지지 않았을 것”이라고 지적했다.
그러면서도 “12년 이상 조울증 아내를 간병하는 등 긴 시간 가장의 책임을 짊어져 왔고, 반사회적 동기로 범행을 한 것은 아니다”며 “본인만 살아남아 평생 죄책감을 안고 살아갈 것으로 보이는 점 등을 감안했다”고 설명했다.
A씨는 지난해 6월1일 오전 1시12분쯤 전남 진도군 임회면 진도항에서 아내와 고등학생 두 아들을 태운 승용차를 몰고 바다로 돌진해 이들을 숨지게 한 혐의로 구속기소됐다.
그는 가족에게 수면제를 먹이고 범행을 저지른 것으로 드러났다. A씨는 사고 직후 열려있던 차창으로 탈출해 홀로 목숨을 건졌다. 그러나 그는 구조 요청을 하지 않고 광주로 도주했다가 경찰에 붙잡혔다.
A씨는 카드 빚 등 2억원의 채무와 자신이 관리한 일용직 노동자들의 임금 3000만원을 체불한 것으로 조사되기도 했다.
‘쌍방울 대북송금 사건’에서 제기된 ‘진술 회유 의혹’을 수사하는 검찰이 김성태 전 쌍방울 회장 2차 소환일을 오는 20일로 재조정 했다.
14일 경향신문 취재를 종합하면 서울고검 인권침해점검 태스크포스(TF)는 김 전 회장에게 오는 20일 오전 10시에 2차 조사를 받으라고 재통보했다. 애초 서울고검은 이날 오전 10시에 김 전 회장을 소환할 계획이었는데 전날 날짜를 조정한 것으로 알려졌다. 김 전 회장은 업무상 횡령 및 배임, 위계에 의한 공무 집행 방해 등 혐의를 받는다.
김 전 회장은 쌍방울 대북송금 사건 재판에서 이재명 대통령에게 불리하게 증언을 번복하도록 안부수 아태평화교류협회장과 그의 딸에게 회삿돈으로 금전적 혜택을 제공하도록 하고, 2023년 5월17일 이화영 전 경기도 평화부지사 등의 조사가 진행된 수원지검 조사실에 연어와 술 등 외부음식을 반입하도록 지시한 혐의를 받는다. 서울고검 TF는 쌍방울 측이 안 회장 측에 제공한 금액이 약 1억원이라 보고 있다. 또 쌍방울 법인카드 내역 중 술을 구매한 사실을 확인했으며, 이 술이 수원지검에 반입됐을 가능성에 무게를 두고 수사하고 있다. 검찰은 1차 조사에서 이와 관련한 내용 등을 추궁한 것으로 알려졌다.
김 전 회장은 자신의 혐의와 관련해 “(안 회장과) 대북사업을 같이했고 앞으로도 필요한 관계에서 모른 척 할 수 없었다”며 “당시 안 회장이 구속된 상태에서 부친을 보살펴야 하는 딸에 대한 도의적인 차원에서 제공한 것이지 ‘진술 회유’ 매수의 목적이 아니었다” 취지로 주장한 것으로 알려졌다. 또 술 등의 구매 경위를 알지 못하고 “조사실에 반입된 사실이 없다”고도 밝혔다.
